Judgment in a case involving defendant's, a former public defender, refusal to respond to grand jury interrogatories on attorney-client privilege grounds is vacated where the district court erred in concluding that the expiration of defendant's first grand jury term and issuance of a new subpoena resulted in a second, removable action.
