Fligiel v. Samson, 04-1531

Grant of summary judgment for defendant-Veterans Administration is vacated and the case remanded for dismissal for lack of subject matter jurisdiction pursuant to United States v. Fausto, 484 U.S. 439 (1988) since the Veterans' Benefits Act effectively precludes judicial review for plaintiff.
