Spirit Airlines v. Northwest, 03-1521
Grant of summary judgment in favor of defendant-airline in an antitrust case involving allegations of predatory tactics in specific geographical passenger airline markets is reversed where there was sufficient evidence that there existed a distinct low fare or leisure passenger market, defendant engaged in predatory pricing practices in the market, and once plaintiff exited the market, defendant raised prices to recoup its losses.
