GLANCY v. TAUBMAN CTRS., INC., 03-1609

Concerning a failed take-over attempt, the court remanded for determination of whether one of the defendants could adequately represent a partnership. If he cannot, the lower court must dismiss, because the partnership is an indispensable party, but cannot be joined because to do so would destroy diversity jurisdiction.
