United States Sixth Circuit

BRENNEMAN v. MEDCENTRAL HEALTH SYS., 02-3623

Summary judgment to defendant is affirmed on claims of disability discrimination and a Family and Medical Leave Act (FMLA) violation. Plaintiff gave insufficient notice that his diabetes-related absences were FMLA-qualifying; even excluding those absences, his excessive absenteeism rendered him unqualified for the Pharmacy Technician position.
