United States Sixth Circuit

KETCHINGS v. JACKSON, 03-1054

Criminal defendant's remorseful remarks at sentencing belie the finding that the sentencing judge was concerned only with defendant's lack of remorse rather than with his unwillingness to admit guilt. To remedy this Fifth Amendment violation, conditional habeas writ is affirmed.
