Elements of a copyright defendant's work that were created prior to access to a plaintiff's work are to be filtered out at the first stage of substantial-similarity analysis. Because no reasonable jury could have found defendant's movie substantially similar to plaintiff's screenplay solely on the basis of the non-filtered remainder, judgment as a matter of law must be entered for defendant.
