US v. PEVELER, 02-5778

Absent an agreement of the parties, the plain language of FRCP rule 11(c)(1)(C) generally precludes the district court from using 18 U.S.C. section 3582(C) to alter the sentence in a plea agreement. This conclusion applies despite the retroactivity of a subsequent amendment to a relevant guideline used to determine the defendant's sentence.
