United States Sixth Circuit
MCFARLAND v. YUKINS, 01-1360
Had prisoner's appellate counsel raised the issue of trial counsel's conflict of interest in her state appeal, her conviction would have been automatically reversed. Appellate counsel's failure to raise the issue was sufficiently unreasonable to violate her right to counsel.
