United States Sixth Circuit

KALAMAZOO RIVER STUDY GROUP v. ROCKWELL INT'L CORP., 01-2453, 02-2192

District court correctly dismissed plaintiff's motion to reopen the CERCLA allocation proceedings, which relieved one defendant of any contribution responsibility, as time-barred under FRCP rule 60(b)(2). Court did not abuse its discretion in allocating to another defendant only a very small portion of plaintiff's investigation costs.
