United States Sixth Circuit

ISHIKAWA GASKET AM., INC. v. NLRB, 02-1167, 02-1310

Substantial evidence supports defendant's finding that plaintiff's anti-union animus motivated its decision to reduce employee bonuses. Plaintiff has not met its burden of establishing by a preponderance of the evidence that it would have made the same decision regardless of the fact that its employees were engaged in protected activity.
