United States Sixth Circuit

COMBS v. INT'L INS. CO., 01-6493

In New York in 1986, defendant anticipatorily repudiated the Directors and Officers liability policy issued to decedent's horse farm. Because Kentucky's borrowing statute requires that New York's statute of limitations be applied, plaintiff's breach of contract claim is eight years late.
