District court's grant of defendant's conditional writ of habeas corpus based on ineffective assistance of counsel is reversed as trial judge only repeated, at the jury's request, specific instructions that had previously been given in the presence of plaintiff's counsel, and thus it is not deemed a critical stage in the proceedings.
