United States Sixth Circuit
NEWTON v. MILLION, 01-6116
The district court's grant of habeas relief is reversed where there is no precedent to suggest that a criminal defendant's right to present a defense includes the right to a specific jury instruction, and the omission of a witness's name neither violated petitioner's right to present a defense nor resulted in constitutional error.
