United States Sixth Circuit

US v. WARE, 01-6031

Defendant sufficiently initiated discussion of the crime and validly waived his rights to remain silent and to counsel, so his subsequent confession was voluntary. The exclusionary rule should not bar the fruits of the search of defendant's apartment where police executed a warrant in accordance with their belief that it was anticipatory.
