Once it is decided that a restraint of trade is subject to per se analysis, claimed lack of any actual anticompetitive effects or presence of procompetitive effects is irrelevant. A horizontal market allocation agreement constituted a restraint of trade that is illegal per se under section 1 of the Sherman Antitrust Act.
