US v. DANIEL, 01-4077

A wire fraud conviction under 18 U.S.C. section 1343 is affirmed, as the government presented sufficient evidence of 1) several material misrepresentations, 2) intent to deprive victim of money, even if only in the short-term, and 3) use of an interstate electronic communication (fax machine) in furtherance of a scheme to defraud.
