MICHIGAN BELL TEL. CO. v. MCIMETRO ACCESS TRANSMISSION SERVS., INC., 01-1312
The Michigan Public Service Commission did not reach an arbitrary and capricious result under Michigan contract law, in finding that a local telecommunications entrant could fax resale orders under an incumbent telephone carrier's tariff terms. The Telecommunications Act of 1996 does not impliedly preempt Michigan's tariff regime.
