The district court's application of 21 U.S.C. section 841(b)(1)(D) as the statutory maximum penalty for an indeterminate amount of marijuana is affirmed. Government's stated reasons for a peremptory challenge of a prospective juror were valid under Batson, and the prosecutor's opening statements did not compromise defendant's right to a fair trial.
