United States Sixth Circuit

US v. CARPENTER, 01-5368/5370/5446

An affidavit in support of a search warrant failed to provide a nexus between the subject residence and illegal activity, but officers reasonably relied in good faith on the warrant when issued. The district court erred in ordering only a partial forfeiture of defendants' property, where the applicable forfeiture statute, 21 U.S.C. sec. 853, mandated forfeiture of the entire property.
