TAHFS v. PROCTOR, 00-1657, 01-1728/1798

A 42 U.S.C. section 1983 claim, alleging a conspiracy to obtain personal protection orders (PPO) in violation of claimant's rights, was properly dismissed because by obtaining a PPO from a state court, a private litigant does not make himself a state actor. Award of attorney fees under FRCP 11 and 42 U.S.C. section 1988 is reversed.
