United States Sixth Circuit

US v. STINES, 00-1222/1594; 01-1119/1179

Although a drug conspiracy alleged in an indictment did not specify the quantity of cocaine and cocaine base, 1) sentences did not trigger Apprendi because drug type and quantity attributed did not affect the statutory maximum, and 2) determination as to drug quantities attributable to other defendants did not constitute plain error.
