US v. CARNES, 00-2103
The government's warrantless seizure of audio tapes from defendant's girlfriend's home violated the Fourth Amendment and, because the district court erred in denying defendant's motion to suppress the tapes, resulting in a conviction for illegal interception of a wire communication, the conviction is reversed.
