United States Sixth Circuit

JERICOL MINING, INC. v. NAPIER, 01-3156

In awarding benefits under the Black Lung Benefits Act, an Administrative Law Judge (ALJ) erred in attributing greater weight to the opinion of a physician simply because he saw claimant more frequently than other physicians, but the court defers to the ALJ's assessment of the physicians' credibility.
