Summary judgment for the Secretary of Kentucky's Justice Cabinet was proper in a police commissioner's 42 U.S.C. section 1983 claim, for termination in violation of the First Amendment, where a memorandum written by plaintiff (which he refused to withdraw) was not protected speech under the First Amendment.
