WESTSIDE MOTHERS, A MICHIGAN WELFARE RIGHTS ORG. v. HAVEMAN, 01-1494

The Medicaid program is not a "contract", but is the "supreme law of the land" as an act passed under Congress's spending power; sovereign immunity will not bar a private (42 U.S.C. section 1983) cause of action for Michigan's alleged failure to provide services required by Medicaid, where only prospective injunctive relief is sought against state officials.
