United States Sixth Circuit

OHIO FARMERS INS. CO. v. LEET, 01-8046

Even though creditors' counsel mailed 11 U.S.C. section 523 dischargeability complaint to the bankruptcy court clerk's office in what should have been sufficient time to assure arrival by the filing deadline, and the court found no intent to delay, it was error for the bankruptcy court to invoke its equitable powers to allow two creditors to file their dischargeability complaint two days past the deadline provided for in Federal Rule of Bankruptcy Procedure 4007(c).
