CICERO v. BORG-WARNER AUTO., INC., 00-1022

In an age discrimination action brought under Michigan's Elliott-Larsen Civil Rights Act ("Elliott-Larsen Act") and common law, the district court misread the requirements for establishing a prima facie case of discrimination, in McDonnell Douglas Corp. v. Green, 411 U.S. 792 (1973), and, because plaintiff raised a genuine issue of material fact regarding defendant's reason for firing him, summary judgment in defendant's favor reversed.
