United States Sixth Circuit

CORNIST v. B.J.T. AUTO SALES, INC., 00-5751

Under the Truth in Lending Act, 15 USC 1601 et seq., the "systematic" disparity requirement is not an element of the cause of action for undisclosed finance charges, but a manner in which circumstantial evidence can be used to prove that a seller is burying the cost of credit in the price of goods sold.
