BERGER v. CITY OF MAYFIELD HEIGHTS, 99-4490

Plaintiffs who have prevailed against state authorities on constitutional grounds need not plead and rely specifically upon 42 USC 1983 in order to secure attorney's fees as a "prevailing party" under the statute.
