MITCHELL v. MASON, 99-1839

Court-appointed counsel's failure to communicate with petitioner or conduct discovery on his behalf violated petitioner's 6th Amendment right to effective counsel, and the absence of trial counsel testimony at an evidentiary hearing does not preclude appellate review of habeas claims.
