ONIFFER v. TYSZKIEWICZ, 00-1043
Although some circumstances of re-sentencing may implicate due process rights of prisoners because of the expectation of finality of judgments, in this case the Michigan appellate court did not violate existing federal law in reversing the sentencing error of the trial court.
