PETRY v. CITY OF TOLEDO, 99-4441

The municipal-proprietor applies to city towing provisions under 49 USC 14501(c), provisions dealing only solely with towers wishing to perform non-consensual police tows for the City, and a rule limiting the number of such towers, do not constitute legal regulation, and are not preempted by 49 USC 14501(c)(1).
