BARTOSZEWSKA-ZAJAC v. IMMIGRATION AND NATURALIZATION SERV., 99-4430

Congress intended the stop-time rule under Section 309(c)(5) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, to apply retroactively to pending applications for suspension of deportation, and any suspension is strictly discretionary.
