Gardner v. CLC of Pascagoula, L.L.C., 17-60072
Reinstated a nursing assistant's claim that a patient created a sexually hostile work environment for her. She alleged that an elderly resident at an assisted living facility groped her and punched her, and that her employer failed to take appropriate action to prevent the repetitive harassment. The Fifth Circuit held that her Title VII harassment claim could move forward, reversing a summary judgment ruling in relevant part.
