United States Fifth Circuit
Dean v. Phatak, 16-20650
Held that a state medical examiner might be entitled to qualified immunity from a claim that he intentionally fabricated an autopsy report. The report contradicted a husband's account that his wife committed suicide, and the husband was tried twice for murder. Vacated the denial of qualified immunity and remanded for further summary judgment proceedings in the husband's civil rights action.
