United States Fifth Circuit

Mississippi Rising Coalition v. City of Ocean Springs, Mississippi, 18-60473

Held that residents could not sue a city for passing a resolution requiring the Mississippi state flag to be flown over municipal buildings. The plaintiffs claimed that flying the flag, which contains the Confederate battle flag in its canton, amounted to unlawful racial steering under the Fair Housing Act because it deterred African Americans from living in or moving to city. Affirmed the district court's ruling that the plaintiffs lacked standing.
