United States Fifth Circuit

US v. Reyes-Contreras, 16-41218

In an en banc decision, overruled numerous circuit precedents in holding that a Missouri conviction of voluntary manslaughter was a crime of violence. Abolished certain distinctions previously used in the circuit in making crime-of-violence determinations. Held that a man who pleaded guilty to illegal reentry was subject to a 16-level sentencing enhancement because he had previously been convicted of killing a person with a baseball bat.
