Okpala v. Whitaker, 17-60391
Vacated a Board of Immigration Appeals' deportation order, in a case involving a man born in Nigeria whose deportation proceedings were reopened in anticipation of his release after a long prison sentence on drug-trafficking charges. Held that the board erred in construing 8 U.S.C. section 1227(a)(2)(A)(iii) to apply to an individual who was a naturalized citizen at the time of conviction.
