Silguero v. CSL Plasma, Inc., 17-41206
Held that a plasma collection center did not violate the Americans with Disabilities Act by allegedly preventing two people with disabilities from becoming paid plasma donors. The center insisted it was not a public accommodation and thus was not subject to the ADA's nondiscrimination mandate. Agreeing, the Fifth Circuit affirmed summary judgment against the ADA claims. However, the panel certified to the Supreme Court of Texas some questions regarding the plaintiffs' rights under the Texas Human Resources Code.
