United States Fifth Circuit
Lopez-Ventura v. Sessions, 17-60529
Reversed a Board of Immigration Appeals order that said a lawful permanent resident could not return to the U.S. after a trip abroad because he had been convicted in Louisiana of possessing a synthetic cannabinoid. The drug was first added to the federal schedules of controlled substances after his arrest. Remanded for further proceedings, noting that the controlled substance listing should not be applied retroactively.
