United States Fifth Circuit

Moon v. City of El Paso, 17-50572

Reinstated a false-imprisonment claim filed by a man who spent 17 years in prison for a crime he did not commit, holding that his claim was timely filed because false imprisonment is a continuing tort under Texas law. Also held that the assistant district attorney enjoyed prosecutorial immunity. Reversed in part and remanded.
