United States Fifth Circuit
Gilmore v. State of Mississippi, 17-60608
Affirmed the dismissal of a civilian employee's claims that her supervisor, a colonel in the Mississippi National Guard, retaliated against her for whistleblowing. The colonel argued that he was a federal employee shielded by the Westfall Act from liability.
