United States Fifth Circuit

Voices for International Business and Education, Inc. v. NLRB, 17-60364

Held that a charter school's employees had a right to unionize. The charter school contended that it was exempt from the National Labor Relations Act because it was a political subdivision of a state. Disagreeing, the Fifth Circuit held that the school was a privately controlled employer and must recognize and bargain with the union that the school's employees had chosen in an election. The panel thus denied the school's petition for review and granted the National Labor Relations Board's cross-petition for enforcement.
