Richards v. Louisiana Citizens Prop. Ins. Corp., 09-31070

In an action against defendant-attorney seeking a contingency fee received by defendant in an underlying Hurricane Katrina property damage case on the ground that plaintiff's mortgage balance exceeded the sum recovered, summary judgment for defendant is affirmed where, under Louisiana law, defendant's privilege for his contingency fee in the settlement funds he obtained for his client was superior to plaintiff's rights.
