United States Fifth Circuit

US v. Rains, 09-50724

Defendants' convictions and sentences for manufacture and sale of methamphetamine are affirmed where: 1) based on the evidence presented, the jury could reasonably conclude defendant possessed the drugs with the intent to sell; 2) the district court did not err in denying defendant's motion to suppress; and 3) 18 U.S.C. section 924(c) could be the basis for an enhancement under section 841(b)(1) when the record made clear that the conviction involved a drug trafficking crime rather than a crime of violence.
