In a personal injury action arising from an offshore drilling accident in Mexico, the dismissal of the action on forum non conveniens grounds is affirmed where: 1) defendant was diligent in bringing the evidence of plaintiff's expert's alleged fraud to the attention of the district court, and did not waive its right to argue the same; 2) plaintiff failed to plainly demonstrate that she was highly unlikely to obtain justice in Mexico; and 3) the bulk of the witnesses and evidence were located in Mexico.
