United States Fifth Circuit
Kane v. Holder, 07-60757
In a petition for review of the BIA's order reversing a decision of the Immigration Judge (IJ) that granted Petitioner's application for withholding of removal, the petition is denied, where: 1) Petitioner's derivative claim for withholding of removal based on potential danger to his daughters was not cognizable; and 2) the Court of Appeals lacked jurisdiction to consider Petitioner's asylum claim.
