Valley Educ. Found. v. Eldercare Props. Ltd., 07-41057

In a motion by the Debtor to assume a real property lease, the Bankruptcy Court's order granting the motion is affirmed, where: 1) Plaintiff failed to terminate the lease, and the lease was properly assumed by the bankruptcy estate; and 2) equitable intervention under Texas law applied to render effective the Debtor's renewal.
