Affiliated Computer Servs. v. Wilmington Trust Co., 08-10235
In an action for breach of an indenture agreement, summary judgment for Plaintiff is affirmed, where: 1) Section 314(a) of the Trust Indenture Act does not impose an obligation to file timely reports with the SEC; and 2) the plain language of the indenture did not impose such an obligation either.
